It is instructive to know that any support provided to you is mainly for the purpose of information. Worthy of note, however, is that we do not receive any confidential or proprietary information via National Driving School website – www.nationaldrivingschool.ie. Hence, any information or material sent will be considered non-confidential. By sending National Driving School any information or material, you grant NDS unfettered access to use, reproduce, display, perform, modify, and transmit such piece of information or material. In a similar vein, we enjoin you not to send information that is defamatory, libelous, offensive, blasphemous, or discriminatory. Trademark More instructively, you are prohibited from displaying or using National Driving School trademarks or logos without apposite permission from the National Driving School. Governing Law Bearing in mind that the governing law is very fundamental in any engagement, the terms and conditions of National Driving School governing law are administered under the NDS law. As a result, the occurrence of conflict and severe dispute under the NDS are to be referred to the courts for judicial adjudication. Lesson Cancellation Policy Irrespective of the situation or circumstance, you are mandated to give us or your instructor at least 48 hours minimum notice before initiating a cancellation or rearrangement of your driver lesson. Case in point you violate this principle, you will be made to pay a fine which is 100% of the lesson fee. In addition, you will have to forfeit your payment fee if you have pre-paid for any lesson but fail to attend or provide the Minimum Notice to cancel or rearrange the lesson. It should be noted that you can neither sell nor transfer any driving lesson form to a third party without our consent. Insurance In the light of offering high-quality insurance, your NDS Instructor will carry the appropriate motor insurance. Case in point you had a collision as a learner driver, NDS instructor will take over the control of the Instructors tuition vehicle. Price Changes Without any iota of doubt, we maintain the right to alter the price of our learner driver products, driving lessons, among others, without your consent. Payment for Lessons Payment for your initial lesson will become payable in advance directly to your instructor who has made contact with you. National Driving School do not take credit card details or hold payments for instructors due to revenue matter’s. Payment can be made via online banking, Revolut or whatever method you prefer as discussed with our RSA Instructor. Refund Policy Without gainsaying, you have the privilege to cancel your driving lessons due to the emergence of an unexpected circumstance but it can only be initiated after earlier giving us 48 hours notice. It is heartening to note that if you have not taken any lesson at the time of cancellation, you will be entitled to an absolute refund of the initial amount paid with regards to the deduction of the refund charge. Instructively, you will be liable to pay an administration charge of 20% of the received amount (minimum of €20 charged) with the aim of facilitating the process for refund. This form of charge is known as the Refund Charge. For proper clarity, the refund is only available within a maximum period of 3 years. Kindly bear in mind that Gift Vouchers are non-refundable and it is only valid for one year. Limitation of Liability While it has been observed that some clients often make mistakes leading to outright loss; we seize this medium to state that neither we (Your Instructor) nor NDS will be responsible for any or loss or damage caused. Most importantly, it should be expressly stated that neither we nor NDS are parties to the contract for driving tuition. This is a deal that is exclusively between you and your instructor. It is heartwarming to note that nothing in these terms and conditions will affect any statutory rights you may have as a consumer. Tyre Damage and Kerbing If for whatever reason on a lesson the tyre or wheel should get damaged or burst due to carelessness or inaccuracy, the cost to repair this then is on the Pupil.
