WHEREAS, the Groomer offers professional dog grooming services; WHEREAS, the Client desires to utilise to Groomer’s services from grooming their dog(s) and/or cat(s) (herein referred to as pet(s)); NOW, THEREFORE, in consideration of the mutual promises and covenants contained herein, the parties agree as follows: 1. Services provided The Groomer agrees to provide standard grooming services, including bathing, brushing, hair styling/trimming, nail trimming/filing, ear cleaning, as well as anything extra, as discussed and agreed upon for the pet. See website www.uptosnuffgrooming.com for add on details and grooming preference. Grooming is a subjective art. While we aim to meet your requests, the final look depends on the pet's coat condition, behavior, and safety constraints. A complimentary 'redo' is only applicable to minor adjustments to the styling (e.g., trimming hair around eyes) within 24 hours. After 24 hours a full re-groom (bath and dry) and/or touch ups will be charged at the full rate. Please note this does not apply to pets that require a mandatory, pre-approved shave-down due to matting. 2. Consent for House Call Grooming: Handling & Grooming Consent: Client gives consent to the Groomer to safely handle and groom my pet(s). I acknowledge that grooming can involve the use of tools, products, and techniques necessary for the pet’s health and hygiene. The client understands and gives permission for the Groomer to perform grooming services for my pet(s) inside my home The client understands that an adult over the age of 18 must be present during the duration of the services. The client prepared to accommodate Groomer at the time of the appointment. The client understands that the Groomer will use my space as “working space” respectfully and return it to a clean and hygienic state after the service. The client understands that a deposit is required at the time of the booking of the appointment. This deposit will be applied to the cost of the services of the appointment. 3. Matting & Coat Condition: I understand that severe matting or coat neglect can result in necessary shaving or shorter trims to ensure the comfort and safety of the pet. The Groomer will always prioritize the pet’s well-being and comfort. Adult present will be informed of matting and steps needed to take for the pets well being and fees 4. Commitment from the Groomer: The Groomer commits to: practicing safe, educated, and gentle handling; maintaining clean, sanitized equipment and work areas; continuing professional education; and respecting client privacy by never sharing personal information. 5. Client responsibilities The client agrees to the following: Appointment/Time of Services: The client will be prepared to accommodate Groomer at the time of the appointment. The client understands that an adult over the age of 18 must be present during the duration of the services. Safe Transfer of Care: The Client acknowledges that they are solely responsible for the safe and secure transfer of the pet to the Groomer. This includes, but is not limited to: Ensuring the pet is properly leashed, harnessed, or crated prior to the Groomer's arrival. Maintaining physical control of the pet until the Groomer has firmly secured the leash or transport equipment. Disclosing any known triggers or reactive behaviors that may occur during hand-offs. The Groomer reserves the right to refuse service at the time of the in-home appointment if the pet is not presented in a safe and controlled manner. Working Space: The Client will make available to the Groomer adequate working space to allow the Groomer to fulfill their obligations under this Agreement. This space will include access to necessary facilities and utilities (e.g., Bathing area with hot water access, safe accessible power outlets, safe hygienic space, etc.) as reasonably required to perform the services requested. Cancellations & Scheduling: Please provide at least 48 hours’ notice for cancellations or reschedules. Groomer will send a confirmation text and/or email 24 hours prior to appointment, If customer does not respond to Groomer’s confirmation text/and or email, Groomer will not arrive for the appointment. Emergencies and/or unforeseen circumstances are understandable but communication is needed. Please provide Groomer timely notice and contact Groomer via email and/or text as soon as possible. Repeat last minute cancellations will result in Groomer retaining deposit and/or possible fee for missed grooming services. Groomer has the right to refuse to continue providing services at Groomer’s discretion. Additionally, in the event the Groomer has an unforeseen emergency and/or inclement weather, Groomer will immediately contact the Client and the Client will receive priority rescheduling. Payment Terms Payment is due at the time of service via cash, card, or electronic payment (Venmo, CashApp, or Zelle). Failure to provide payment at time of service will result in refusal of future appointments. Depending upon the Customer’s home location, Groomer may add a gas surcharge or travel fee. Health: The Client agrees to immediately inform the Groomer of any and to provide accurate and complete information regarding the pets(s), including, but not limited to, health status and/or condition, medical conditions, behavioral issues (e.g., anxiety, aggression), allergies, and/or sensitivities that may affect the grooming process. The Client certifies to the best of their knowledge that the pet is healthy, and free from contagious diseases or parasites. Vaccinations: That the pet(s) are up-to-date on state required vaccinations (Rabies, Bordetella recommended) by providing Groomer proof of vaccination which may be requested prior to grooming services unless a rabies waiver is signed. Veterinarian Release: I hereby authorize my veterinarian to release information to Up to Snuff Grooming as it pertains to vaccines or any health issues that may affect the grooming process. 6. Veterinary Care: If emergency veterinary care is deemed necessary for the health of the pet, Groomer will immediately advise the adult present of the occurrence. The Groomer is not responsible for the transport, and/or fees for veterinarian. 7. Photo release/social media: The client grants the groomer permission to take photos/videos of their pets during their grooming sessions for promotional and marketing purposes. The groomer will not release any identifying information in photo/videos without prior consent at the time photo/video is taken. The client may opt out of this release by providing written notice to the groomer prior to the grooming appointment. 8. Governing Law: This agreement shall be governed by and construed in accordance with the laws of the state of Tennessee, without regard to its conflict of law principles. 9. Liability Waiver The client agrees to hold, harmless and indemnify the Groomer, its employees, agents, and affiliates from any, and all claims, damages, losses, or expenses, arising out of or in connection with the grooming services provided, including, but not limited to, any claims for injury or damages to the pets, or any other person or property. I understand that the Groomer takes every precaution to ensure the safety of all pets. I agree not to hold the Groomer liable for injury, illness, or stress-related conditions that may occur during or after grooming if found not to be due to Groomer negligence. If I or another person choose to assist or remain present during grooming, I assume full responsibility for any injury to myself or others. 10. Limitation of Liability: Groomer shall be liable for any indirect, incidental, special, or consequential damages arising from the services provided under this agreement, even if the groomer has been advised of the possibility of such damages. The total liability of the groomer under the agreement shall be limited to the amount paid by the client for the services. 11. Dispute resolution: In the event of any dispute arising under this agreement, the parties agree to attempt to resolve the dispute through informal negotiation. If the dispute cannot be resolved, informally, the parties agreed to submit to mediation before seeking any other legal remedies. 12. NON BINDING AGREEMENT either party can discontinue grooming services. 13. Severability If any provision of this agreement is held to be invalid or unenforceable the remaining provisions shall continue in full force and effect.
